1. Acceptance of Agreement
By downloading, installing, activating, or using the "Simple Donation System" plugin (hereinafter, the "Software"), you (hereinafter, the "User" or "You") agree to be bound by the terms and conditions of this End User License Agreement (EULA).
If you do not agree to these terms, you must not install, activate, or use the Software.
2. Definitions
- "Software": The "Simple Donation System" plugin for WordPress, including all its components, files, documentation, and updates.
- "Free Version": The version of the Software distributed through WordPress.org under GPL v2 or later license.
- "PRO Version": The version of the Software with additional features, distributed through Freemius under commercial license.
- "Licensor" or "Developer": Hector Luis Barrientos, owner and developer of the Software.
- "User" or "You": The person or entity using the Software.
- "Freemius": The distribution and licensing platform used for the PRO version. https://freemius.com
- "Site": A single WordPress installation where the Software is installed and active.
3. License Types
3.1 Free Version (WordPress.org)
The Free Version is distributed under the GNU General Public License v2 (GPL v2) or later, in accordance with WordPress.org requirements.
Under GPL v2, you can:
- Use the Software for any purpose
- Study how the Software works and adapt it to your needs
- Redistribute copies of the Software
- Improve the Software and publish your improvements
GPL v2 Conditions:
- Modifications must be distributed under the same GPL v2 license
- You must include the copyright and license notice
- You must provide access to the source code

3.2 PRO Version (Freemius)
The PRO Version is distributed under a commercial license through Freemius. This license is in addition to GPL rights and grants access to:
- Additional PRO features
- PRO updates and improvements
- Priority technical support

Note:
The PRO license must be renewed annually to maintain access to updates and support. The installed Software will continue to work after expiration, but without access to new updates.
4. Usage Restrictions
4.1 Free Version
Subject only to GPL v2 conditions.
4.2 PRO Version
In addition to complying with GPL v2 for the base code, you may NOT:
- Use the PRO Software on more sites than authorized by your license type
- Share, redistribute, or resell PRO license keys
- Circumvent or disable the license validation system
- Use license keys obtained fraudulently
5. Data and Privacy
5.1 Donor Data
The Software stores donor data (name, email, address, tax data, payment reference information) in the database of the site where it is installed.
The Developer:
- Does NOT have access to donor data
- Does NOT store donor data on their servers
- Is NOT responsible for processing donor data
The User (site owner):
- IS the sole responsible party for processing donor data
- MUST comply with GDPR, CCPA, and applicable regulations
- MUST provide privacy policy to donors
5.2 Buyer Data (PRO Version)
When purchasing the PRO version, Freemius and the Developer collect data according to the Privacy Policy available at Privacy Policy.
6. Warranties and Limitations
6.1 Software "As Is"
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement of third-party rights
- Uninterrupted or error-free operation
6.2 No Guarantee of Results
THE DEVELOPER DOES NOT GUARANTEE THAT:
- The Software will meet your specific requirements
- The Software will operate without interruptions or errors
- Defects will be corrected
- The Software will be compatible with all themes, plugins, or WordPress configurations
- The Software will generate specific results (donations, revenue, etc.)
6.3 Payment Processors
The Developer is NOT responsible for:
- Errors or failures of payment processors (Stripe, PayPal, Redsys, etc.)
- Rejected or failed transactions
- Disputes or chargebacks
- Financial losses related to payments
6.4 Limitation of Liability
IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, revenue, or donations
- Business interruption
- Costs of substitute services
- Any other damage, regardless of the theory of liability
MAXIMUM LIMITATION:
The Developer's total liability shall not exceed the price paid for the Software license in the 12 months prior to the event giving rise to the claim.
6.5 Indemnification
You agree to indemnify and hold harmless the Developer against any claims, damages, losses, or expenses arising from:
- Your use of the Software
- Your breach of this EULA
- Your breach of data protection regulations
- Third-party claims related to donor data
7. Support and Updates
7.1 Free Version
- Community support through WordPress.org forums
- Critical security updates
- No guaranteed response time
7.2 PRO Version
During the active license period:
- Priority technical support via email
- Access to all updates
- Target response time: 48-72 business hours
After license expiration: The installed Software will continue to work, but without access to new updates or priority support.
8. Termination
8.1 Termination by User
You may terminate this EULA at any time by uninstalling the Software from all your sites.
8.2 Termination by Developer
The Developer may terminate this EULA if:
- You violate any term of this EULA
- You use the Software fraudulently
- Your PRO license is revoked by Freemius
9. Refunds
Refunds for the PRO version are subject to Freemius policy:
- Period: Generally 30 days from purchase
- Conditions: According to Freemius terms
- Process: Through Freemius panel or by contacting [email protected]
10. Applicable Law and Jurisdiction
This EULA is governed by the laws of Spain.
Any dispute related to this EULA shall be submitted to the exclusive jurisdiction of the Courts of A Coruña, Spain.
Before initiating legal action, the parties commit to attempting to resolve disputes in good faith through direct negotiation for a minimum period of 30 days.
11. General Provisions
- Complete Agreement: This EULA, together with the Privacy Policy and Freemius Terms (for PRO version), constitutes the complete agreement between the parties.
- Modifications: The Developer may modify this EULA. Modifications will be published with an update date and will take effect 30 days after publication.
- Severability: If any provision is invalid, the others remain in effect.
- Waiver: Not exercising a right does not constitute waiver of that right.
- Assignment: You may not assign this EULA without the Developer's written consent.

12. Acceptance
Free Version: By downloading or installing the Software from WordPress.org, you accept the terms of the GPL v2 license and applicable sections of this EULA.
PRO Version: By purchasing, downloading, installing, or activating the PRO version, you acknowledge that you have read, understood, and agree to be bound by all terms of this EULA and Freemius Terms of Service.
